In 2017, HHS OCR finalized the rule implementing Section 1557 of the Affordable Care Act of 2010. Section 1557 is the non-discrimination provision of the ACA and states that individuals cannot be subject to discrimination based on their race, color, national origin, sex, age, or disability.
